GENERAL TERMS AND CONDITIONS OF THE HOLIDAY HOME PRI STARI MAMI.

General terms

These terms and conditions are a part of the booking agreemen for the holiday home Pri stari mami, between the guest, who requests the booking, and Andreja Fridman Vidovič s.p., who confirms the booking. The confirmed booking is considered as a valid contract between the two parties. A part of these general terms and conditions are the house rules.

In cases of in-person, phone, or online reservations, it is considered that the guest agrees with the general terms and conditions at the time of booking. The general terms and conditions can be found at www.pristarimami.si. The guest is any person who made the booking, or paid for it, and is subject to these terms and conditions. The host is the private individual Andreja Fridman Vidovič s.p..

Booking the accommodation

The guest can book the accommodation either directly at the local shop Pri stari mami, 2258 Sveti Tomaž, or at www.pristarimami.si. The guest is obliged to provide required information in order to confirm the booking. In case the guest fails to provide correct information, they are responsible for all related costs incurred.

The booking agreement is binding for the guest. The guest can withdraw from the said agreement only in accordance with the cancellation terms. In addition to an explicit written booking or a valid contract, every order forwarded in oral or written form, which contains the first and family names of the guest, the number of other guests, credit card number or identification of another payment instrument, payment of the reservation or part of it, payment of reservation costs, are considered as binding, as well as a conclusive action indicating that the guest has submitted a binding reservation application or a reservation application containing any of the above information. The booking of the accommodation is considered confirmed on the date of written confirmation by the host or by any authorized external associate. The guest can change certain details of the booking after the confirmation, such as the dates of stay, number of guests, etc., under the condition that such a change is possible without the need to cancel the booking. The host will accommodate such a change if possible.

Payment

The date on which the guest makes the payment at the register of the host, or the bank account of Andreja Fridman Vidovič s.p. receives an online transfer, is considered as payment date. The guest pays 30% of the full price at the time of booking and the remainder at check-in. A correct and on-time payment for the booking, in accordance with these general terms and conditions, guarantees the accommodation in the Pri stari mami holiday home to the guest. Otherwise, the host is not obliged to accommodate the guest in the Pri stari mami holiday home. The guset can make the payment with cash. In accordance with the terms and conditions of non-cash operations of financial institutions, the host cannot refund cash to the guest in the event of a ahead-of-time cancellation in the case of non-cash payment (online transfer to bank account) for the accommodation, but the guest can request a credit note from the host if he is entitled to it, or receives a refund to their bank account.

Prices of the accommodation

The guest can visit the web page of the Pri stari mami holiday home to see the prices of the accommodation. The host is not responsible for the prices set by unauthorized parties if they differ from the prices on the valid price list. All discunts or benefits are mutually exclusive and do not add up. If several discounts are applicable, the guest can choose the one that suits them best.

Services included in the price of the accommodation

The price of the accommodation includes the services listed in the price list on the hosts website, unless otherwise specified. The prices stated in the price list are valid for the holiday home per day, unless otherwise specified.

Special services related to the accommodation

Special services are those services that are not included in the price of the accommodation (excursions, tourist taxes, cleaning, pets, transport, sports activities...). Therefore, the guest pays for them separately, unless otherwise specified. If the guest decides to use such additional services, they inform the host when booking the accommodation, and they are paid in addition to the price of the accommodation. The tourist tax is always paid at the place of accommodation and amounts to 1.5 €/day for adults and 0.75 €/day for children aged 7-18. Children under the age of 7 are exempt from tourist taxes.

Cancellation terms

The guest has the right to cancel the booking. In the event that the guest cancels the booking, the host has the right to reimbursement of costs incurred due to the cancellation. The amount of reimbursement depends on the date on which the guest submitted the cancellation request: Within 7 days before, and including the arrival date – 30% of the price of the accommodation The guest must submit the cancellation in a written form. If they refuse to do so, it is considered that there was no cancellation. Anytime throughout the stay, the guest can cancel their stay on their own accord, by submitting a written statement of cancellation. In the event that the guest cancels mid-stay, they have no right to reimbursement of costs incurred, or to reimbursement for the accommodation, either partially or fully. In the event of a mid-stay cancellation at the guests request, or due to unforseen circumstances, without there being any reason for that on the part of the host due to improperly performed service, the guest has no right to request any compensation or discounts.

The host's withdrawal

The host has the right to withdraw from the contract if the agreed upon amount has not been paid within the agreed time period. Exceptionally, they may also withdraw from the contract due to a legitimate reason (e.g. due to unforseen circumstances or other circumstances for which the host is not responsible, or due to misleading or incorrect essential information provided by the guest).

The host's guarantee

The host guarantees his contractual obligations with the diligence of an honest contractual party. This exludes the guest's claims for compensation (unless it concerns damage caused by intentional or serious breach of contractual obligation). If there is a disturbance during the guest's stay or damage is caused to the guest, the host will make every effort to rectify it as soon as possible. The guest is obliged to contribute to the elimination of the disturbance in the accommodation or that the damage caused is as small as possible. The host is liable for any damage to the guest's belongings in accordance with applicable legislation, only in the event that the damage is related to a breach of duty by the host. The host does not take responsibility for the guest's vehicle parked in the host's parking lot, nor for their belongings stored in the vehicle, unless the damage is a deliberate act of the host or the result of negligence by the host.

Data privacy policy

The data obtained from the guests is secured by the host in accordance with the Personal Data Protection Act. By confirming the booking, the guest is considered to agree to the use of their data for the purpose of fulfilling contractual obligations and rights, and also for the purposes of statistical processing and notifying about the host's offers. If the guest does not wish to participate in the latter, they can declare this when booking the accommodation.

Final terms

VAT is not included in the prices from the host's offer, because the host is not liable for VAT under article 94. from the VAT act Zakon o DDV-1. In the event of a dispute between the contractual parties, the court in Ptuj has jurisdiction over all disputes. These general terms and conditions apply to all contracts made since the date of their publication on the host's website.
